Waiver

WAIVER:

This waiver (“Waiver”) is between the undersigned and Venus Bike Club, a Colorado non-profit corporation (hereafter, “Venus Bike Club”). 

  1. I am 18 years of age or older. By signing, I affirm that I have read and understand the terms of this Waiver, as detailed below.
  2. I understand that I am giving up substantial rights by signing this Waiver. I have agreed to the Waiver voluntarily and without any inducement or assurance of any nature, and I intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. I agree that if any portion of this Waiver is held to be invalid, the balance of the Waiver shall continue in full force and effect.
  3. I acknowledge, agree, and represent that I understand the nature of bicycling and bicycling-related activities, including without limitation, events and trips organized or sponsored by Venus Bike Club, social and organizational meetings and events, and any other activity or event organized or sponsored by Venus Bike Club or any of the Releasees named below (together, the “Activities”), and that I will participate only in those Activities for which I am qualified and in sufficiently good health and proper physical condition. I further acknowledge that certain Activities will be conducted in public and private venues, including on public roads and trails, upon which hazards of traveling are to be expected. I further agree and warrant that if at any time I believe conditions are unsafe, I will immediately discontinue further participation in the Activities.
  4. I fully understand that:
    1. The Activities involve risks and dangers, inherent and otherwise, including but not limited to serious bodily injury, including permanent disability or paralysis, and death (“Risks”);
    2. These Risks may be caused by my own actions or inactions, the actions or inactions of others participating in the Activities, the conditions in which the Activities take place, the actions or inactions of third parties, or the negligence of the “Releasees” named below, among other potential causes; and
    3. There may be other risks and social and economic losses either not known to me or not readily foreseeable at this time. I EXPRESSLY ACCEPT AND ASSUME ALL RISKS OF THE ACTIVITIES, INCLUDING THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE, AND LOSS resulting therefrom, whether or not described here, known or unknown, inherent or otherwise. I EXPRESSLY ACCEPT AND ASSUME ALL RESPONSIBILITY FOR ALL LOSSES, COSTS, DAMAGES, AND INJURIES I incur as a result of my participation in any of the Activities.
  5. IN CONSIDERATION FOR BEING ALLOWED TO PARTICIPATE IN THE ACTIVITIES, I AGREE TO WAIVE ANY AND ALL CLAIMS AGAINST AND TO HOLD HARMLESS, RELEASE, INDEMNIFY, AND AGREE NOT TO SUE the Venus Bike Club or any of its administrators, directors, agents, officers, members, volunteers, committee members, ride leaders or sweeps, employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises on which any of the Activities takes place (each considered one of the “RELEASEES” herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES related in any way to the Activities. I agree to pay all costs and attorneys’ fees incurred by any Releasee in defending a claim or suit brought by me, my estate, or on my behalf. I understand that this Waiver will apply each time I engage in any Activities.
  6. I FURTHER AGREE that in consideration for being allowed to participate in the Activities, I FURTHER RELEASE AND GIVE UP ANY AND ALL CLAIMS AND RIGHTS THAT I MAY NOW HAVE AGAINST ANY RELEASEE AND UNDERSTAND THIS RELEASES ALL CLAIMS, including those of which I am not aware, those not mentioned in this release, and those resulting from anything which has happened up to now.
  7. I acknowledge that Releasees may take photographs or video of me during Activities, and I grant permission to Releasees to include photographs and video of me on the Venus Bike Club website(s), social media sites, and other similar public and private sites, as well as in text, email, newsletters, and any other promotional, marketing, communication, or informational material that Venus Bike Club or Releasees may use or produce.
  8. I acknowledge that I will comply with the rules, directions, and procedures established by Venus Bike Club. If at any time I cannot abide by the Venus Bike Club’s rules, directions, procedures, and safety measures, including implementation of such measures (including by leads and sweeps during Venus Bike Club-sponsored rides), I will cease my participation in the Activities and EXPRESSLY ACCEPT AND ASSUME ALL RESPONSIBILITY FOR ALL LOSSES, COSTS, DAMAGES, AND INJURIES related to such cessation of participation in the Activities.
  9. This waiver of liability and release extends to all Releasees. I have read and understand the release of liability, waiver of claims, and assumption of risk provisions herein, and I agree to abide by and adhere to its terms. This Waiver remains in effect until a revocation is: (i) made in writing, (ii) delivered to Venus Bike Club at its last official mailing address, and (iii) emailed to contact@venusbikeclub.org. Revocation of the Waiver immediately terminates membership in Venus Bike Club, and upon such revocation, I agree not to participate further in any Activities.
